Privacy Policy.

How we collect, use, share, and protect your information.

1. Who we are

This Privacy Policy applies to Secure Capital Solutions Inc, a New Jersey corporation ("SCS," "we," "us," "our"), and the website at securecapitalsolutions.com. SCS is a commercial financing intermediary (broker / ISO) as defined in our Disclosures. Because SCS is in the business of arranging financial services, we are a "financial institution" within the meaning of the federal Gramm-Leach-Bliley Act (GLBA), and certain of the disclosures below are required by GLBA.

2. Information we collect

We collect the following categories of information:

  • Information you provide directly through the application form or through email/phone contact: name, email address, mobile phone number, business name, requested funding amount, industry, time in business, monthly revenue range, and similar identifiers necessary to evaluate and route your application.
  • Information from third parties, including consumer reporting agencies (soft credit pull at the application stage; full credit pull only with separate authorization at a later stage), bank statement aggregators (when you authorize a bank-link), and Lender Partners with whom your application is shared.
  • Automatically collected information: IP address, browser type, device type, referring URL, and pages visited, as standard for any website. We do not currently use analytics cookies; if we add them, this Policy will be updated.

3. Why we collect it — GLBA initial privacy notice

GLBA requires us to disclose the categories of nonpublic personal information ("NPI") we collect and how we use and share it.

Categories of NPI collected: identifiers you provide on the application; financial information about your business (revenue, deposits, debt service); and information from consumer reporting agencies if you authorize a credit pull.

Categories of affiliates and nonaffiliates with whom NPI is shared: SCS has no corporate affiliates. Nonaffiliates with whom we share NPI include: Lender Partners (third-party funders to whom we present your application), service providers (see §5), and as required by law.

Right to opt out: Federal law gives you the right to limit some, but not all, sharing of NPI with nonaffiliates. Sharing required to perform the financing intermediation service you have requested (i.e., presenting your application to Lender Partners) is exempt from the opt-out under the joint-marketing/processing exception. 4. How we share information with Lender Partners

The core purpose of SCS’s service is to present your application to one or more third-party Lender Partners we believe match your business profile. By submitting an application, you authorize SCS to share the information in your application — including your name, contact information, business information, requested amount, and any documents you provide — with one or more third-party Lender Partners we determine appropriate for your file. Each Lender Partner has its own privacy policy and data-handling practices. We select Lender Partners based on industry coverage and credit policies, not on highest-paying referral fees.

5. Service providers we use

To operate this site and process your application, we use the following third-party service providers:

  • Formspree — processes our application form submissions and forwards them to our internal email. Application data is retained in Formspree’s infrastructure until manually purged.
  • Vercel — hosts this website. Standard server logs (IP, user agent, request URL) are retained per Vercel’s standard log retention.
  • Future analytics provider — we may add an analytics provider (such as Plausible or Google Analytics) in the future. If we do, this Policy will be updated to identify the provider and the data collected.
  • Future CRM provider — we may migrate application intake to a CRM (such as HubSpot, GoHighLevel, or similar) in the future. If we do, this Policy will be updated.

All service providers act as our processors and are contractually limited to using your information for the purposes we authorize.

6. Retention

Application leads are retained in Formspree’s inbox-forward infrastructure until manually purged. Our recommended retention is 24 months from receipt with quarterly reviews. Application records that result in funded transactions are retained longer, as required by record-keeping laws applicable to commercial financing arrangements. You may request earlier deletion of your data subject to our legal record-keeping obligations by submitting a request through our contact form or by calling 201-676-3971.

7. California residents — CCPA / CPRA notice

If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) gives you specific rights:

  • Categories of personal information we collect: identifiers (name, email, phone, IP address); commercial information (business identifying information, requested funding amount); financial information (revenue and deposit data you provide); and internet activity (pages visited, referring URL).
  • Sources: directly from you; from third-party data providers if you authorize a credit pull or bank-link; from your interaction with our website.
  • Business purposes: to evaluate and route your application; to communicate with you about your application; to comply with legal obligations.
  • Sale or share status: SCS does not sell personal information. SCS shares personal information with Lender Partners as described in §4 above, which is the core service purpose, not a "sale" under California law.
  • Your rights: request access to the categories and specific pieces of personal information we have; request deletion (subject to legal record-keeping exceptions); request correction; opt out of sale (not applicable to us, as we do not sell); designate an authorized agent.
  • How to exercise rights: submit a request through our contact form, selecting “Something else” and noting “California Privacy Request” in your message, or call us toll-free at 201-676-3971. We may verify your identity before responding.

8. SMS and TCPA

If you check an SMS-consent box on our application form or our contact form, you consent to receive SMS text messages from SCS at the mobile number you provided — and, where you separately check the Lender Partner box on the application, from Lender Partners — regarding your inquiry, application status, follow-up, financing options, and offer notifications. SMS consent is not a condition of applying for, contacting us about, or receiving any service, and each consent box is unchecked by default. Reply STOP to opt out, HELP for help. Standard message and data rates may apply. Message frequency varies. We do not sell or share mobile numbers or SMS consent with third parties or affiliates for their own marketing purposes. 9. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your information, including HTTPS-encrypted transmission of all form submissions, access controls on data destinations, and limited employee access. No method of electronic transmission or storage is 100% secure; we cannot guarantee absolute security.

10. Children’s privacy

This site is intended for business operators and is not directed to children under 13. We do not knowingly collect personal information from children under 13.

11. Changes to this Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via this page; continued use of the site after changes constitutes acceptance.
